Terms and conditions of sale — draft

1. Purpose and scope

Adoucisseur-Eau.lu is published by The CMO.lu S.à r.l.-S, a Seliac partner. Services are provided by Seliac. The model terms below still require validation by Seliac and do not constitute its contractual terms. The seller’s identity and applicable conditions must be specified in the contractual documents given to the customer before an order is placed.

2. Products and services

The Seller offers the supply and installation of Adoline water softeners, maintenance and after-sales services. Specifications on the website’s product pages are provided for information.

3. Prices

Prices are stated in euros including VAT at the applicable Luxembourg rate of 17%. The supply-and-installation price includes equipment, delivery, installation and commissioning. A reduced 3% VAT rate may apply to eligible main-residence renovation work, subject to conditions and approval by the Administration de l’Enregistrement, des Domaines et de la TVA (AEDT). Prices may be updated; the applicable price is the price in the accepted quotation.

4. Quotations and orders

A quotation is provided before any service. The order becomes binding when the Customer accepts the quotation in writing. The Seller reserves the right to confirm installation compatibility during a visit or water test.

5. Payment

Payment arrangements, including any deposit and the balance due on delivery or installation, are specified in the quotation. Any payment facilities are agreed individually.

6. Installation and timing

Installation is carried out by the Seller’s technicians, generally within half a day to a full day depending on the existing plumbing. Timeframes are indicative. The Customer must ensure access to the premises and suitable water-inlet and drainage facilities.

7. Warranty

The Adoline range carries a 5-year commercial warranty under the manufacturer’s terms. The Customer also benefits from the statutory warranties applicable in Luxembourg, including conformity and hidden-defect protections. The warranty does not cover normal wear or damage resulting from inadequate maintenance, misuse or third-party intervention.

8. Right of withdrawal

Where the Customer is a consumer and the contract is concluded remotely or away from business premises, a 14-day withdrawal period applies under the Luxembourg Consumer Code. Exceptions include goods made to the Customer’s specifications and services fully performed before the end of the period with the Customer’s express agreement and acknowledgement of the loss of the withdrawal right. A Customer requesting installation before the end of the period must expressly request it.

9. After-sales service and maintenance

The Seller provides maintenance, salt supplies, adjustments and repairs. Annual maintenance is recommended to preserve the equipment’s efficiency and service life.

10. Liability

The Seller cannot be held responsible for damage caused by improper use, lack of maintenance or external causes. The Seller undertakes to use reasonable efforts regarding water-quality results, which depend in particular on the original water hardness.

11. Personal data

Data collected for an enquiry or order is processed in accordance with our privacy policy.

12. Applicable law and disputes

These terms are subject to Luxembourg law. In the event of a dispute, the parties will seek an amicable solution. Consumers may contact a competent consumer mediator in Luxembourg. If no agreement is reached, the Luxembourg courts have jurisdiction.
